Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Nmami Life Platform. These Terms constitute a legally binding agreement between you (“User”, “you”) and Nmami Life Pvt Ltd (“Nmami Life”, “we”, “us”), a company incorporated under the Companies Act, 2013.

By accessing our website, creating an account, or purchasing any programme or service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

1. Eligibility

You must be at least 18 years of age to use the Platform and enter into this agreement. By using the Platform you represent and warrant that you meet this requirement. If you are accessing the Platform on behalf of a minor, you take full responsibility for their use and agree to these Terms on their behalf.

The Platform is intended for use by residents of India. We do not represent that the Platform complies with the laws of any other jurisdiction. Users outside India access it at their own risk.

2. Services

Nmami Life provides an online platform connecting individuals with qualified dietitians and nutritionists for personalised nutrition guidance. Our services include, but are not limited to:

• Personalised nutrition and diet plan programmes.
• One-to-one video and chat consultations with registered dietitians.
• AI-assisted meal planning tools and in-app chat support.
• Educational content on nutrition, wellness, and healthy living.
• Progress tracking and follow-up check-ins.
• Sale of nutrition-related products and digital guides (where available).

Not medical advice. The content on the Platform, including diet plans, articles, AI-generated responses, and advice from our dietitians, is intended for informational and educational purposes. It does not constitute medical advice, diagnosis, or treatment, and is not a substitute for consultation with a licensed physician or specialist. Always consult your doctor before starting any new nutrition or wellness programme, particularly if you have a medical condition, are pregnant, or are taking prescription medications.

3. Account Registration & Security

To access most features of the Platform you must create an account by providing accurate and complete information. You agree to:

• Provide truthful, current, and accurate information during registration and onboarding.
• Keep your login credentials confidential and not share them with anyone.
• Notify us immediately at ask@nmami.in if you suspect any unauthorised access to your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are inactive for an extended period.

4. Programmes, Bookings & Payments

Purchasing a programme: When you purchase a nutrition programme or book a consultation, you enter into a contract with us for the specified services. Programme details, duration, deliverables, and pricing are set out on the relevant product page at the time of purchase.

Pricing & taxes: All prices are displayed in Indian Rupees (INR) and are inclusive of Goods and Services Tax (GST) unless stated otherwise. Nmami Life reserves the right to revise pricing at any time; changes will not affect existing confirmed bookings.

Payment processing: Payments are processed securely by Razorpay Technologies Private Limited. By making a payment, you also agree to Razorpay’s Terms of Service. Nmami Life does not store your card, bank, or UPI details.

Cancellations & refunds: Please refer to our Refund Policy for full details on cancellations, rescheduling, and eligibility for refunds.

5. Dietitian Engagement

Dietitians on the Platform are independent professionals who are contracted by Nmami Life to deliver services. While Nmami Life verifies their qualifications and credentials, we are not liable for the specific clinical judgements or recommendations of any individual dietitian. Your dietitian will work with you on the basis of the information you provide; the quality of your plan depends on the accuracy and completeness of that information.

You agree to treat dietitians and Nmami Life staff with respect at all times. Abusive, threatening, or otherwise inappropriate behaviour may result in immediate termination of your account.

6. AI Features & Chat

The Platform includes AI-assisted chat and content-recommendation features powered by large language models. You acknowledge that:

• AI-generated responses are automated and may not account for your complete medical history or individual circumstances.
• AI outputs should not be treated as medical advice; always confirm significant dietary changes with your assigned dietitian or physician.
• Conversations with AI tools may be reviewed by your dietitian or Nmami Life staff for quality assurance and safety purposes.

7. Acceptable Use

When using the Platform you agree not to:

• Violate any applicable law, regulation, or the rights of any third party, including intellectual property rights.
• Post, upload, or transmit content that is false, misleading, defamatory, obscene, hateful, or invasive of another person’s privacy.
• Attempt to gain unauthorised access to any part of the Platform, other users’ accounts, or our servers.
• Use automated tools (bots, scrapers, crawlers) to extract data from the Platform without our prior written consent.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Platform to transmit unsolicited commercial messages or spam.
• Upload or transmit viruses, malware, or any other malicious code that may compromise the security or functionality of the Platform.

8. Intellectual Property

All content on the Platform — including text, graphics, logos, diet plans, articles, video, software, and AI-generated outputs provided to you as part of your programme — is the intellectual property of Nmami Life Pvt Ltd or its licensors, and is protected by Indian and international copyright, trademark, and other laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its content solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercialise any content from the Platform without our prior written consent.

By submitting content to the Platform (such as progress photos or feedback), you grant us a royalty-free, worldwide licence to use, reproduce, and display that content solely for the purpose of operating and improving our services.

9. Third-Party Services & Links

The Platform may integrate with or link to third-party websites and services. These links are provided for your convenience only. Nmami Life does not control third-party sites and is not responsible for their content, privacy practices, or availability. Your use of any third-party service is governed by that service’s own terms and conditions.

10. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Nmami Life disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We do not guarantee any specific health outcome, weight-loss result, or other benefit from using our services. Individual results vary and depend on many personal factors outside our control.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Nmami Life Pvt Ltd, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of (or inability to use) the Platform, even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising from your use of the Platform shall not exceed the total amount paid by you to us in the three (3) months preceding the event giving rise to the claim.

Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Nmami Life, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform in violation of these Terms; (b) your violation of any applicable law or third-party right; or (c) inaccurate or incomplete information you have provided to us.

13. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Platform. You may also close your account at any time by contacting us. Termination does not entitle you to a refund unless specified in our Refund Policy.

Sections that by their nature should survive termination (including Sections 8, 10, 11, 12, and 14) shall continue to apply after termination.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or the services provided shall first be attempted to be resolved through good-faith negotiation between the parties.

If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator mutually agreed upon by the parties. The venue of arbitration shall be New Delhi, India. Proceedings shall be conducted in English.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction in New Delhi.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, applicable law, or business practices. We will notify you of material changes by posting a notice on the Platform or by email at least fourteen (14) days before the new terms take effect. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.
